End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you and Astramara, LLC ("Astramara") for the PassageMaster™ software application, including the installable progressive web app (PWA), updates, and accompanying documentation (the "Software"). The Software is part of the PassageMaster™ service and is also governed by the Terms of Service. By installing or using the Software, you agree to this EULA.

The Software made available today is the progressive web app. PassageMaster™ is not available in the Apple App Store or on Google Play. This EULA is not a certified-navigation claim and not a certified-ENC claim.

1. License grant

Astramara grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on devices you own or control, solely for your personal or internal business cruising purposes and in accordance with this EULA, the Terms of Service, and the Acceptable Use Policy.

2. Offline use

The Software is designed to work offline. You may install it and cache the application shell and permitted data for offline use aboard your vessel. Certain third-party content (for example, streamed satellite map tiles) may be subject to caching restrictions imposed by the relevant provider; see the Third-Party Data Attribution notice.

3. Restrictions

You must not, except to the extent applicable law prohibits this restriction:

• copy, modify, or create derivative works of the Software, other than local caching required for normal use;
• reverse engineer, decompile, or disassemble the Software, or attempt to derive its source code;
• rent, lease, lend, sell, sublicense, or otherwise commercially exploit the Software;
• remove or alter any proprietary notices; or
• use the Software to build a competing product or to scrape or bulk-extract data.

4. Updates

The Software may check for and apply updates. Updates are provided to maintain or improve the Software and are governed by this EULA unless a separate license accompanies them. We are not obligated to provide updates or support for any particular period.

5. Ownership

The Software is licensed, not sold. Astramara and its licensors retain all right, title, and interest in and to the Software, including all intellectual-property rights. See the Copyright Notice.

6. Open-source components

The Software includes open-source components licensed under their own terms, listed in the Open-Source Notices. Nothing in this EULA limits your rights under those open-source licenses. In case of conflict, the applicable open-source license governs that component.

7. Disclaimers and limitation of liability

The Software is provided "AS IS" without warranties of any kind, and Astramara's liability is limited, as described in the Terms of Service and Disclaimers. PassageMaster™ is decision-support only and is not a substitute for official charts, certified navigation equipment, or prudent seamanship.

8. Termination

This EULA is effective until terminated. It terminates automatically if you breach it. On termination, you must stop using and remove the Software. Sections 3, 5, 7, and 9 survive termination.

9. General

This EULA is governed by the law and dispute terms in the Terms of Service. If any provision is unenforceable, the remainder stays in effect.
